YOUR THREE NON-NEGOTIABLE RIGHTS IN COURT & BEYOND

RIGHT #1: THE RIGHT TO REMAIN SILENT (5th Amendment)

Street Definition: "SHUT THE FK UP. (Politely.)"** You are never legally required to explain, justify, or narrate your actions to the police. Your words are evidence, and they will be used against you.

What It Really Means:

· Applies: From the moment of a police encounter, through arrest, and in court.
· You Must Explicitly Invoke It: Say: "I am invoking my right to remain silent and will not answer any questions without my attorney present."


· Then, ACTUALLY REMAIN SILENT. Do not then give your "side of the story."

What To Say & Do:

· "I am going to remain silent."
· "I want a lawyer." (Say this. It automatically invokes your right to silence.)
· DO NOT lie, make excuses, or try to "talk your way out of it." Silence cannot be twisted.

RIGHT #2: THE RIGHT TO AN ATTORNEY (6th Amendment)

Street Definition: "GET THE PRO." You are not qualified to fight the system alone. This is your right to a trained expert whose only job is to defend you.

What It Really Means:

· If you cannot afford one, the court must appoint a public defender.
· It begins the moment your case goes to court (arraignment).
· DO NOT PLEAD GUILTY OR DISCUSS A PLEA DEAL without consulting your attorney. Ever.

How to Find Your Lawyer: A Real-World Guide

Don't assume you have no options. Your life is worth the hustle.

1. Public Defender: Your first ask in court. Provided at no cost if you qualify (low income).
2. Pro Bono & Legal Aid: Non-profit law firms that provide free services. Search "[Your City/State] legal aid" or "pro bono legal services."
3. Community Law Clinics: Often run by law schools or non-profits. They offer free advice and sometimes representation.
4. Private Attorneys: DON'T ASSUME YOU CAN'T AFFORD ONE.
   · Consultations: Many offer free or low-cost first meetings. Call a few. Ask exactly what they charge.
   · Payment Plans: Many will work out a payment plan. Ask.
   · Flat Fees vs. Hourly: For some cases (like simple DUIs or misdemeanors), they may charge a flat fee instead of a huge retainer.

What To Say & Do:

· "I will not answer any questions without my attorney."
· "I am exercising my right to an attorney."
· To the court: "I need a public defender."
· DO NOT assume you can't get a lawyer. Ask for one immediately.
· Start calling. Your first call should be to local legal aid. Your second should be to a private attorney for a consultation quote.

RIGHT #3: THE RIGHT TO BE FREE FROM UNREASONABLE SEARCH & SEIZURE (4th Amendment)

Street Definition: "WHERE'S YOUR WARRANT?" Police cannot search you, your car, or your home without a good, articulable reason (probable cause) or your consent.

What It Really Means:

· "Probable Cause" means specific facts, not a "hunch."
· You have the right to deny consent to any search.
· If they search anyway, clearly state: "I do not consent to this search." This preserves your rights for court.

***NEVER CONCENT TO  A SEARCH  If they had evidence of you doing something wrong they wouldn’t need your consent they would detain you and search the ride BECAUSE evidence of wrong doing give them the right under Probable Cause.

So unless you in to dry snitchin’ check the chit chat  the  moment  they are close enough to hear you talkin’

We  All Need to keep calm and not be answering anything beyond the essential phrases:

”Is there a reason I’m being pulled over officer

 

· Officer: "Can I search your vehicle?"
· You: "Officer, I do not consent to any searches." (Say it calmly and clearly).
· DO NOT physically resist a search. Verbally deny consent, then let your lawyer challenge it later.
